If we would like to get into the mind of a fraudster we must understand what is behind fraud. According to an article there are three main categories. There are the gullible people, who are lured into fraud by third parties. There are the desperate, who need cash due to debt. The third category is the real criminal, for them fraud is a way of life. These people distance themselves from the sense of guilt by depersonalizing the victim or shifting the blame on him.
According to a survey the main reason for corporate fraud is personal crisis, gain and greed.White collar crimes are on the rise but sometimes corporates turn to the so called deferred prosecution agreement: they pay a fine and avoid the possibility of criminal conviction.
GDPR (General Data Protection Regulation) comes into force in May 2018. As part of the effort of the EU to curb abuse and protect the data of customers, GDPR will impose enhanced obligations around data management for companies of all sizes. However, the majority of companies are unaware of this and surprisingly few firms know that the fines can be as high as 20 million euros or 4% of the global turnover. But as we know ignorance of the law is no defence.
Companies will have to develop a comprehensive data security strategy. Before giving their consent customers of companies have to fully understand how their data will be used, and through the right to erasure their data should be destroyed if requested. A data protection officer will have to be appointed and all data breaches will have to be reported within 72 hours.
The law will not only apply to electronic but also to physical data. Printed confidential data must be also treated with equal care. Sending every piece of documents to the shredder may be a painstakingly slow process. So companies may need to review current processes as inaction may mean violating the GDPR, which may expose companies to damaged reputation and financial penalties.
